Storing your store’s trash bins

Just a few years ago (2023), most ground floor businesses kept their trash indoors. If they did not, they could face a $100 minimum fine. Then, in the evenings, black bags were moved from indoors (basement, store, yard) and set out at the curb. For the vast majority of the day, the sidewalk areas near businesses were clear and storefronts did NOT have unsightly trash cans chained up.

Now – the streetscape has a LOT more trash containers. The trash bins block store windows which is prime space for views into stores, signage, and merchandise displays. Or, the bins are used to block an open basement hatch (cellar door). Have you noticed basement hatches staying open longer these days?

So – what is the new law? What is a business required to do, and what is the fine for non-compliance?

Bins should be stored inside or in a rear yard if possible, when not set out for collection.

If space is not available, bins can be stored within three (3) feet of the building line.

DSNY can issue a citation – it starts at $50.

Bins must be maintained in a neat and orderly manner and always allow for a clear path of pedestrian travel on the sidewalk.
